House Advances Grove Bill to Restore Checks and Balances
HARRISBURG – The House today moved to restore checks and balances on the Independent Regulatory Review Commission (IRRC) when it approved
House Bill 2649, Rep. Seth Grove (R-Dover) said.
Grove’s bill would add two appointments to the Independent Regulatory Review Commission (IRRC) to balance the power the governor’s office has over the commission. One of the new commissioners would be appointed by each the majority leader of the House of Representatives and the by the majority leader of the Senate. The IRRC would also be required to act by a majority of the commissioners, and an agency would be barred from issuing a final-form or final-omitted regulation if the commission disapproves its report.
“The governor’s appointee to the IRRC generally serves as the tiebreaker when votes among commissioners appointed by the General Assembly are tied. The governor’s appointee’s tie-breaking powers circumvents the IRRC’s mission of being a check on the rulemaking actions of the administration,” Grove said. “My bill would balance out power on the commission and protect the checks and balances system, which is an essential aspect of government.”
House Bill 2649 now goes to the Senate for consideration.
