Grove Submits Testimony on Proposal to Subvert the General Assembly

HARRISBURG – As the Independent Regulatory Review Commission prepares to rule on the Human Relations Commission’s (PHRC) proposal to define sex, race and religious creed under the Pennsylvania Human Relation Act (PHRA) and the Pennsylvania Fair Education Opportunities Act, Rep. Seth Grove (R-York) noted in his written testimony that the proposal circumvents the Legislature. 

“Therefore, the PHRC may not only be acting without statutory authority, or sufficient legislative intent, but also promulgating regulations that would disrupt the proper separation of powers between the branches of Pennsylvania’s government,” Grove wrote in the letter. 

The PHRC proposes to create a new Subchapter D relating to protected classes. Specifically, this proposed rulemaking would provide definitions for the terms “sex,” “race” and “religious creed.” 

Grove was adamant in his letter that the power to create new definitions does not lie with the PHRC, but with the Legislature. To read his letter, click here.
