Grove Applauds House Passage of Fair Share Act

Measure would benefit job seekers

and anyone who accesses health care in Pennsylvania

HARRISBURG – Rep. Seth Grove (R-Dover) today applauded the passage of legislation to address lawsuit abuse, increase employment opportunities in Pennsylvania and help patients seeking medical care in the Commonwealth.

“The Fair Share Act is about reducing the trend of employers avoiding Pennsylvania and doctors fleeing our state,” said Grove.  “The civil justice system should be fair to everyone – plaintiffs and defendants.  Holding defendants that are minimally responsible for the lion’s share of the damages because they have the deepest pockets is imbalanced.  The system is not only negatively impacting defendants, but it also is stifling growth for our entire Commonwealth.”

Grove noted that Pennsylvania has the reputation of having one of the worst civil justice systems in the nation, making businesses leery of locating here and forcing doctors to practice elsewhere.

House Bill 1 would allow the courts to hold defendants in a lawsuit liable for their share of damages and no more.  Under current law, a defendant who is minimally liable can be forced to pay 100 percent of the damages and cover the compensation that parties bearing a greater share of the responsibility cannot afford.

This legislation is part of a greater effort by House Republicans to increase prosperity in Pennsylvania by bringing more jobs to the state.  Increasing employment opportunities has been a priority for Grove.

“Unemployment claims have been falling over the past few months, but Pennsylvania can do more to help its citizens get back to work,” said Grove.  “Creating an environment in which employers are comfortable conducting business and doctors are secure practicing is truly a way to improve the quality of life for every resident of this Commonwealth.”

Grove, who co-sponsored House Bill 1, voted in favor of the legislation. It will now go the Senate for consideration.
